Warranty conditions

1. guarantee period and scope of application

Bauer Trading GmbH provides consumers and corporate customers with a voluntary manufacturer’s warranty of 5 years for the following products in addition to the statutory warranty to which the consumer is entitled:

SX100, SX150, SX100-P, SX150-P, SX180-P, SJ480. Not for the Ultra series and not for electronic items. The two-year statutory warranty applies here.

The period for calculating the warranty period begins from the date of purchase by the first customer (invoice date), but no longer than 1 year after manufacture. The warranty period shall not be extended due to the provision of services under this warranty, in particular not in the case of replacement or repair. In such cases, the warranty period shall not begin anew.

This warranty in no way limits or restricts valid, legal provisions of the customer and is valid for all lithium batteries mentioned above with a purchase date from 11.12.2020. Excluded are accessories, consumables and supplements to the product.

The geographical scope of guarantee protection is Europe-wide.

2. prerequisites and assertion

The prerequisite for a warranty claim is a defect or malfunction which no longer allows the battery to be used as intended or which disproportionately restricts its use.

Claims under this warranty must be made by notifying the manufacturer in writing immediately, but no later than 14 days after the defect or anomaly occurs. In the event of a warranty claim, please contact us as the guarantor:

In order for a warranty claim to be processed, it must include a copy of the proof of purchase and a description of the suspected defects. Without a copy of the invoice, the guarantor may reject the warranty claim. To check the warranty claim, the guarantor must be given the opportunity to inspect the goods by sending them in.

Care must be taken to ensure that damage to the goods during transportation is avoided by using secure packaging.

3. warranty service

The warranty services are limited in each case to a maximum of the value of the purchase price originally paid. The liability of the  Bauer Trading GmbH’ s liability under this warranty is limited to the replacement, repair or reimbursement of the product. The choice of replacement, repair or reimbursement of costs is the sole responsibility of the guarantor. If the defective product is no longer in the delivery program, the guarantor reserves the right to replace it with a technically equivalent product from the current range.

All defective batteries or components replaced as part of a warranty service become the property of Bauer Trading GmbH when the warranty service is rendered.

Further claims, in particular for compensation for direct or indirect damage caused by the defect in the appliance, the costs incurred by removal and installation or loss of profit, are excluded, unless liability is prescribed by law.

4. exclusion

The warranty does not cover damage, defects and malfunctions caused by:

1. force majeure (e.g. lightning, overvoltage, storms, flooding, fire)
2. normal wear and tear
3. mechanical impact or the effects of force such as transportation damage, dropping, deformation,
4. improper, abusive or negligent handling or use,
5. Incorrect installation or commissioning
6. Malfunction of other connected devices,
7. Non-observance of safety precautions,
8. independent modifications, programming or repairs,
9. the non-intended use in accordance with. Operating instructions or otherwise inappropriate handling of the goods

5. place of performance and jurisdiction

This guarantee is subject to German law. The place of performance for the obligations arising from this guarantee is Freiburg, Germany. As far as permissible, the place of jurisdiction is Freiburg, Germany.
